1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The Superintendent of Police, West Champaran at Bettiah and the Investigating Officer of the case are present in the Court in compliance of the order dated 23.08.2024.

3. The Superintendent of Police, West Champaran at Bettiah submits that on account of some miscommunication the order dated 23.08.2024 could not be complied in its true letter and spirit. It is further submitted that notice in accordance with law under Section 41(A) of the Cr.P.C. shall be issued to the petitioner.

4. The Superintendent of Police, West Champaran at Bettiah has also filed his show cause and the Court is satisfied with the pleadings made therein.

5. The show cause is accepted.

6. Since it has been submitted by the Superintendent of Police, West Champaran at Bettiah that notice under Section 41(A) of the Cr.P.C. shall be issued to the petitioner as such no useful purpose would be served by keeping the case pending.

7. Accordingly, the present anticipatory bail application is disposed of in view of the submissions made by the Superintendent of Police, West Champaran at Bettiah.

8. The personal appearance of the Superintendent of Police, West Champaran at Bettiah and the Investigating Officer of the case is dispensed with.

9. Since the anticipatory bail application has been disposed of as such the learned Additional District and Sessions Judge-IX, West Champaran at Bettiah is not required to furnish his explanation.

10. Let a copy of this order be sent to the learned District Judge, West Champaran at Bettiah for its onward communication to the learned Additional District and Sessions Judge-IX, West Champaran at Bettiah.
