JUSTICE SUDHIR SINGH ORAL ORDER 11-08-2016 Since both the cases arise out of Digha P. S. Case no. 80 of 2015, they have been heard together and are being disposed of by this common order.
The petitioners seek bail in a case instituted under Sections 461 and 379 of the Indian Penal Code and Section 66 (c) (D) of the I.T. Act.
Allegation is that Government of India authorized NCR to install 16 ATM machines in Bihar and Jharkhand. Later on, large amount of money was found shortage in three ATM machines. Petitioners have been made accused on the basis of confessional statement of the co-accused.
Patna High Court Cr.Misc. No.25685 of 2016 (3) dt.11-08-2016 2/2 It has been submitted on behalf of the petitioners that they are in custody since 23.8.2015 and 24.8.2015 respectively. Petitioners are not named in the F.I.R. On the basis of confessional statement of the co-accused, petitioners have been made accused. There is no substantive evidence to suggest their implication in the present case. Other co-accused has been granted bail by a coordinate Bench of this Court vide Cr Misc. no. 948 of 2016.
On behalf of the State, it is submitted that one Gautam is the mastermind of the alleged occurrence and he is a Software Engineer. On his direction such withdrawal has been made. Petitioner's name has come in course of investigation. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, in connection with Digha P.S. Case no. 80 of 2015.
