JUSTICE SANJAY PRIYA ORAL ORDER 3/ 29-08-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in Buxar (T) P.S. Case No.101 of 2017 instituted for the offence under Section(s) 25(1-b)a, 26, 35 of the Arms Act.

It is alleged in the written report that one country made pistol and ten live cartridges were recovered from the possession of this petitioner.

Petitioner is said to be in custody since 10.03.2017. Counsel for the State has submitted that there are two cases pending against this petitioner.

Counsel for the petitioner has submitted that he has been granted bail in both the cases.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.35416 of 2017 (3) dt.29-08-2017 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Buxar (T) P.S. Case No.101 of 2017, subject to the conditions: (i) that both the bailors shall be close relative of the petitioner, (ii) that petitioner shall remain present on each and every date of trial and his absence on two consecutive dates without proper and reasonable reason will amount to cancel bail bond of the petitioner and (3) that the petitioner will cooperate in the trial and will not tamper with the evidence or influence the witnesses of the case.
