ANJANA MISHRA ORAL ORDER 17-11-2016 At the outset, learned counsel for the petitioners submits that petitioner no. 1 has been taken into custody and therefore, the application against him has become infructuous. Accordingly, the application, as against petitioner no. 1, is dismissed being infructuous.
Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner no. 2 apprehends her arrest in connection with Parbatta P.S. Case No. 37 of 2016 for the offences registered under Sections 406, 409, 467, 468, 471 and 120(B) of the Indian Penal Code.
So far as petitioner no. 2 is concerned, learned counsel
for the petitioner submits that there is no cogent material on record to implicate the present petitioner. It is further submitted that earlier Junior Engineer and Mukhiya, under whose supervision the MANREGA Scheme had been conducted, have been extended the privilege of anticipatory bail vide order dated 27.06.2016 passed in Cr. Misc. No. 17534 of 2016 and its analogous case. However, after the present application was filed, co-accused, namely, Bambam Kumar @ Bambam Kumar Chaudhary @ Bambam Chaudhary, who is said to have using his JCB machine was taken into custody and has since been released on regular bail vide order dated 06.10.2016 passed in Bail Application NO. 956 of 2016 by the Court of Sessions at Khagaria.
Considering the fact that the petitioner, Ranju Kumari @ Ranju Devi's case stands on similar footing as she too is said to have taken an amount of Rs.1.40,000/- for supplying her vehicle/tractor for the purpose of conducting the MANREGA Scheme and the fact that petitioner has got no criminal antecedent, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten
thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, -1, Khagaria in connection with Parbatta P.S. Case No. 37 of 2016,subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
