JUSTICE SANJAY PRIYA ORAL ORDER 07-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Darpa P.S. Case No. 39 of 2017 instituted for the offence under Sections 272, 273, 34of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
It is alleged that total 720 bottles each containing 300 ml. of Nepali Soffy were recovered from possession of this petitioner and co-accused Pramod Sah.
It is mentioned in paragraph-3 of the bail petition that petitioner has no criminal antecedent. Petitioner is said to be in custody since 18.5.2017.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
Patna High Court Cr.Misc. No.37355 of 2017 (2) dt.07-08-2017 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judege cum Special Judge, Excise Act, Motihari, East Champaran, in connection with Darpa P.S. Case No. 39 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
