JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-364, 366(A) of the Indian Penal Code. The victim has already been recovered and her statement u/S 164 of the Cr.P.C. has been recorded. No doubt, the victim appears to be minor but she has, nowhere, stated in her statement about any allurement, given by the petitioner rather she stated that she by her own sweet will, eloped with the petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.31626 of 2016 (2) dt.16-08-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jurawanpur P.S. Case No. 16 of 2016 to the satisfaction of learned Additional Chief Judicial MagistrateVIII, Vaishali, at Hajipur.
