2. The petitioner in the present case is seeking prearrest bail in connection with Buniyadganj P.S. Case No. 292 of 2022 registered for the offenses punishable under Sections 406, 420, 467, 468, 471, 34 of the Indian Penal Code. The petitioner has no criminal antecedent.
3. As per the prosecution story, the informant had purchased a plot bearing no. 553/1990 under an agreement dated 08.01.2022 and she had given cheque of Rs.5,00,000/- for the same and had transferred money online also. When she applied for mutation, she came to know that the land belongs to the Bihar Government. When the same was brought to the knowledge of the petitioner, he refused to return the money.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.57049 of 2023(2) dt.30-08-2023 2/3 petitioner has been falsely implicated in this case. It is further submitted that the vendor Dr. Arun Kumar @ Arun Kumar has already been granted privilege of pre-arrest bail by a learned coordinate Bench of this Court in Cr. Misc. No. 15095 of 2023.
5. Learned APP for the State has opposed the prayer for bail of the petitioner.

Having regard to the facts and circumstances of the case wherein the vendor Dr. Arun Kumar @ Arun Kumar has already been granted privilege of pre-arrest bail by a learned coordinate Bench of this Court in Cr. Misc. No. 15095 of 2023 and in course of investigation it has been reported that 0.58 decimal of land still remains in the name of said petitioner and the vended land is a rayati land, let the petitioner who has otherwise no criminal antecedent, in case of his arrest or surrender within a period of four weeks from today, be released on bail in connection with Buniyadganj P.S. Case No. 292 of 2022 on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VIII, Gaya subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
7. And further condition that the court below shall

No.57049 of 2023(2) dt.30-08-2023 3/3 verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
