This is an application for bail in connection with Sakra P.S.Case No. 260 of 2016 registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.

Petitioner is named in the FIR and in this case two persons were killed.

It has been submitted on behalf of the petitioner that FIR shows no specific overt act against the petitioner and though in paragraphs 12 & 13 of the case diary petitioner has been named as one of the conspirators but a title suit is pending between the parties, as such, he has falsely been implicated in this case and one

Patna High Court Cr.Misc. No.22535 of 2017 (5) dt.13-07-2017 2/2 co-accused has been granted bail in Cr.Misc.No. 6226 of 2017, vide order dated 7.3.2017.

Heard learned APP and learned counsel for the informant also. They have opposed the prayer for bail stating that the petitioner is main conspirator.

Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.

However, let trial be expedited.
