JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 The petitioner seeks regular bail in connection with Udwantnagar P.S. Case No. 175 of 2016, registered for offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R. is that petitioner and others came and assaulted the son of informant and also fired on him causing his death and petitioner and co-accused Vishal Kumar was seen having country made pistols in their hand. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and earlier police after investigation had submitted final form. It has also been submitted that no specific allegation has been attributed to the petitioner and one of the co-accused of this case has already been enlarged by a coordinate Bench of this Court vide order
Patna High Court CR. MISC. No.51231 of 2019(4) dt.16-11-2019 2/2 dated 18.04.2019 passed in Cr. Misc. No. 24948 of 2019 and petitioner has been in judicial custody since 24.06.2019. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case and also the fact that one of the coaccused has already been enlarged on bail by a coordinate Bench of this Court, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Bhojpur, Ara, in connection with Udwantnagar P.S. Case No. 175 of 2016 with condition that petitioner has to cooperate in disposal of trial and make himself available as and when required by the Trial Court.
