JUSTICE RAVI RANJAN ORAL ORDER 15-07-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 364, 34, 302 and 201 of the Indian Penal Code.

As per the allegation, about 24 persons named in the FIR including the petitioner forcibly took the father of the informant and assaulted him with lathi, danda and brick etc. Later on, his dead body was recovered from maize field.

It is contended that post mortem report does not show any external injury and cause of death is shown to strangulation, which has been noticed by a coordinate Bench of this Court in the order dated 15.03.2016 passed in Cr. Misc. No.1668/2016 while granting bail to the co-accused Manoj Manjul @ Manoj Manjil @

Patna High Court Cr.Misc. No.26642 of 2016 (2) dt.15-07-2016 2/2 Manoj Kumar, who is also named in the FIR. The petitioner claims to be in custody since 17.03.2016 having clean antecedent. That apart it is claimed that allegations are general and omnibus in nature.

Considering the facts and circumstances of the case, the petitioner, namely, Ramanand Prasad is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Azimabad P.S.
