Petitioner was caught and one country made loaded pistol along with three live cartridges were recovered from his conscious possession and for the same occurrence, two cases i.e. Bhagwanpur P.S. Case no. 225/2014 for the offences under sections 399, 402, 414/34 of the Indian Penal Code as well as present case were registered against the petitioner.
Learned counsel appearing for the petitioner submits that no doubt, earlier several cases were registered against the petitioner but last case was registered against him in the year 2008 and after that police roped the petitioner in the present case as well as in Bhagwanpur P.S. Case no. 225/2014.
Considering the aforesaid facts and circumstances as well as the period of detention of the petitioner in jail custody, let the
Patna High Court Cr.Misc. No.13307 of 2015 (2) dt.19-05-2015 petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Bhagwanpur P.S. Case no. 226/2014.
