The petitioner is languishing in custody in a case registered for the offences punishable under Section 387 of the Indian Penal Code.
It is alleged by the informant that one Md. Inaytullah demanded Rs. 10 lakhs as rangdari from the informant and threatened of dire consequences, if demand is not fulfilled.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named
Patna High Court CR. MISC. No.60226 of 2023(2) dt.11-09-2023 2/2 in the F.I.R and the name of the petitioner surfaced during the course of investigation. The petitioner has no concern with the alleged incidence. The petitioner is languishing in custody since 25.12.2022.
In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the fact aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Manjhaul, Begusarai in connection with Khodawandpur P.S. Case No. 197 of 2022.
