The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 600 pouches (each containing 200 ml) country made liquor and 24 bottles (each containing 375 ml) foreign liquor were recovered from a car in which two persons were boarding including the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 16.06.2017.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten

Patna High Court Cr.Misc. No.46787 of 2017(2) dt.21-09-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Gaya in connection with Rampur P.S. Case No. 188/17.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
