The petitioner seeks bail in Marhowrah P.S. Case No. 200 of 2009, corresponding to Sessions Trial No. 30A of 2011, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.
The petitioner is alleged to have assaulted the deceased with dagger, hence I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected. The trial is in progress. Seven prosecution witnesses have already been examined. The trial court is directed to expedite the trial and conclude the same within six months from the date of receipt/production of a copy of this order.
The Superintendent of Police, Saran is directed to
Patna High Court Cr.Misc. No.10366 of 2015 (3) dt.11-05-2015 2/2 produce the remaining witnesses on the date fixed in Sessions Trial No. 30A of 2011, arising out of Marhowrah P.S. Case No. 200 of 2009.
