JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Chhatauni P.S. Case No.96 of 2018, registered for offences punishable under Sections 420, 424, 406, 467, 468, 385, 504 and 120B of the Indian Penal Code.
As per F.I.R., allegation against the petitioners, who happens to be proprietor and worker of Survi Credit and Construction Company, Mathiya Zirat is of committing forgery to issue "No dues Certificate" with regard to new vehicle Tata Indico Car E.C.S. and also snatched the car purchased by the informant for which the informant and her husband deposited money.

No.45078 of 2018 (2) dt.01-08-2018 2/2 Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case and the informant had purchased car after taking loan of Rs. 5,00,000/- from the Company but she did not return regularly and lastly the vehicle has been taken possession by the company. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender be released on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Chhatauni P.S.Case No. 96 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
