The petitioner seeks bail in a case instituted for the offences under Sections 414, 120B of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act.
Prosecution case, in short, is that one country made pistol and 7 live cartridges are recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.7.2019. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that one country made pistol and 7 live cartridges are recovered. So far as motorcycle is concerned, the petitioner has got no concern with the same. There is no compliance of Section 100 Cr.P.C.
On behalf of the State, it is submitted that the
Patna High Court CR. MISC. No.50937 of 2019(2) dt.16-08-2019 2/2 petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Pipra P.S.
