JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since19.11.2014 in a case registered for the offences punishable under Sections 364, 302 and 201/34 of the Indian Penal Code. It is alleged that eight-years-old-son of the informant went missing on 12.11.2014. Subsequently, his dead body was recovered from a water channel. Suspicion was raised against the petitioner due to old enmity.
It is submitted by the learned counsel for the petitioner that there is no direct evidence collected so far against the petitioner and only on suspicion the accusation has been levelled. It is submitted by learned counsel for the informant that during investigation the witnesses have suggested that the
Patna High Court Cr.Misc. No.11072 of 2015 (2) dt.30-03-2015 2/2 petitioner was found roaming around the house of the informant on the alleged date of occurrence. The dead body was recovered with bleeding injury near the ear of the victim and the accusation has been levelled on the basis of circumstantial evidence. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Bhojpur at Ara in connection with Sahar P.S. Case No. 174 of 2014.
