JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code, 370 of Human Trafficking Act and Sections 23/24 of J.J. Act, 2000.

The informant as well as one victim, namely, Phuljana Khatoon specifically state that they left their home by their sweet will and while they were weeping at Bettiah Railway Station petitioner took them to his house where informant and victim were made captive and after that they were shown to some persons by the petitioner. The informant and victim were recovered from the house of the petitioner but neither informant

Patna High Court Cr.Misc. No.28101 of 2016 (3) dt.29-09-2016 2/2 nor the second victim state any ill treatment to the hands of petitioner, who is languishing in jail custody since 10.04.2016 without having any criminal antecedent. The investigation against the petitioner has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 160 of 2016.
