This is an application for bail in connection with Maranchi P.S.Case No. 64 of 2016, G.R.No. 1551 of 2016, registered for the offences punishable under Sections 25(1-B)(a) and 26 of the Arms Act.

Allegation against the petitioner is of recovery of one loaded with three cartridges pistol and six other cartridges from his possession and it further appears that he is in accused in six other cases.

Submission of learned counsel for the petitioner is that six other cartridges are of the said pistol and which cannot be used in that pistol. Further submission is that, as a matter of fact, he has been arrested in a case under Section 307 IPC and thereafter has

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.

However, since the petitioner is in custody for more than 11 months, learned trial court is directed to expedite the trial by conducting it on day to day basis and try to conclude it within a period of five months. At the same time, Senior Superintendent of Police, Patna is directed to ensure the presence of the witnesses in court so as to conclude the trial within the period specified.
