2. A prayer for bail has been made on behalf of the petitioner in connection with Banmankhi P.S. Case No.556 of 2023 registered for the offence under section 394 of the Indian Penal Code.
3. The allegation in the F.I.R is that one Anmol Kumar and other criminals looted the tractor loaded with fertilizers.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R and his name has transpired during course of investigation on the confessional statement of co-accused Amarjeet Kumar made before police. Besides his confession, no material has come to connect the petitioner in the
Patna High Court CR. MISC. No.55382 of 2025(3) dt.15-11-2025 2/3 alleged offence. Learned counsel for the petitioner submits that the said tractor was recovered in an abandoned condition. Similarly situated co-accused Ranjeet Yadav has already been granted bail by a co-ordinate Bench of this Court vide order dated 19.04.2025 passed in Cr. Misc. No. 5524 of 2025. The petitioner is in custody since 22.05.2025 and undertakes to cooperate in the case/trial.
5. The application for bail is opposed by learned APP for the State.
6.Taking into consideration the fact that name of the petitioner has transpired during course of investigation on the basis of confessional statement of co-accused Amarjeet Kumar which has no evidentiary value in the eye of law, similarly situated co-accused Ranjeet Yadav has already been granted bail by a co-ordinate Bench of this Court vide order dated 19.04.2025 passed in Cr. Misc. No. 5524 of 2025 coupled with the fact that petitioner is in custody since 22.05.2025, the petitioner is directed to be enlarged on bail in connection with Banmankhi P.S. Case No.556 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court where the case is pending/Successor Court, subject to the
Patna High Court CR. MISC. No.55382 of 2025(3) dt.15-11-2025 3/3 following conditions:- (I) One of the bailors of the petitioner shall be the family member/close relative of the petitioner. (II) He shall co-operate in the trial and would make himself available on each and every date fixed by the trial Court and in case of non-appearance on any date without any sufficient reason, the learned trial Court is at liberty to cancel the bail bonds.
