04.08.2016 Heard learned counsel for the Petitioner as well as learned Additional Public Prosecutor for the State. The Petitioner seeks bail in a case registered for the offences under Section 47 of the Bihar Excise Act. Two Hundred Twenty litres of toddy kept in separate jerkins were recovered beneath the seat of a train. The petitioner was found sitting on the same seat. Petitioner is in jail custody since 04.05.2016 and submission on her behalf is that the said recovery has not been made from her conscious possession. It is also submitted that the petitioner does not have any criminal antecedents and has been arrested in this case only on the basis of suspicion.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let

Patna High Court Cr.Misc. No.30263 of 2016 (2) dt.04-08-2016 the Petitioner, above named be released on bail on furnishing bail bonds of Rs. 5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of concerned Judicial Magistrate, 1st Class (Rail) Patna in connection with G.R.P.
