1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Sessions Trial Case No. 472 of 2022 arising out of Raghunathpur P.S. Case No. 16 of 2021 dated 19.01.2021 registered for the offence(s) punishable under Section(s) 498A/34 of the Indian Penal Code and later on, Section 304B and 302/34 of IPC and Section 3/4 of D.P. Act were added.

3. Mr. Ajay Kumar Tiwary, learned counsel for the petitioner submits that this is second attempt of the petitioner to get the relief of regular bail as his earlier bail prayer was rejected by this bench vide order dated 13.03.2023 passed in Cr. Misc. No. 32906 of 2022 with giving him a liberty to renew his bail prayer after one year, if any significant progress is not made

Patna High Court CR. MISC. No.59079 of 2024(2) dt.06-09-2024 2/2 in his trial and the petitioner has again come before this court mainly on the basis of the said liberty as till date only four prosecution witnesses, including the informant, out of six have been examined and moreover, the said witnesses were declared hostile. It is further submitted that the petitioner has been languishing in jail since 05.04.2022 and he is a young person.

4. Mr. Pramod Kumar Pandey, learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the above submissions and mainly taking into account the petitioner's custody period as well as the stage of his trial, this court is now inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Sessions Trial Case No. 472 of 2022 arising out of Raghunathpur P.S. Case No. 16 of 2021.
