The petitioner seeks bail in a case registered for offence under section 379 of the Indian Penal Code.

The allegation is of theft of a motorcycle and the FIR has been lodged against unknown person. The petitioner along with others was apprehended from a mechanic shop from where ten stolen motorcycles were recovered. Petitioner was remanded in this case from Ballia (Kotwali) Police Station case No. 551 of 2017 in which he has already been granted bail. Petitioner is in custody since 18.05.2017. He also submits that on the basis of such arrest, other co-accused Cham Cham Ram has already been allowed bail by a Bench of this Court vide order dated 11.07.2017, passed in Cr.Misc.No. 30293 of 2017.

In the facts of the case, prayer for bail of the petitioner is

Patna High Court Cr.Misc. No.37072 of 2017 (2) dt.10-08-2017 2/2 allowed. Let the petitioner, as mentioned above, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Buxar (T) Police station Case No. 120 of 2017.
