The petitioner seeks bail in Gopalpur P.S. Case No. 191 of 2020, registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, the FIR named accused persons committed the murder of brother of the informant. Learned counsel for the petitioner submits that Petitioner is not named in the FIR. Name of the petitioner has transpired during course of investigation in the self confessional statement of the petitioner recorded in Kako PS case No. 128/2020 and except the confessional statement there is no other material to suggest the complicity of this petitioner in the

Patna High Court CR. MISC. No.65954 of 2021(2) dt.25-02-2022 2/2 aforesaid crime. Petitioner is in custody since 28.01.2021 and investigation in this case is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IX, Patna in connection with Gopalpur P.S. Case No. 191 of 2020.
