====================================================== CORAM: HONOURABLE MR. JUSTICE GOPAL PRASAD ORAL ORDER 21-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.
This is a petition for grant of anticipatory bail in a case under Sections 498A and 323 of the Indian Penal Code. There is allegation of demand of dowry and on non-fulfilment of the same, subjecting to cruelty. The petitioner is the husband of the complainant. Learned counsel for the petitioner submits that the petitioner is ready to keep the complainant with due dignity and honour.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on provisional bail for four months
Patna High Court Cr.Misc. No.35894 of 2014 (3) dt.21-04-2015 in the event of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Complaint Case No. 599(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr. P. C. as well as the petitioner shall either keep the complainant with due dignity and honour or pay maintenance worth Rs.1,200/- per month till any higher maintenance is fixed by the competent authority and the trial court on being satisfied that the condition is fulfilled then shall confirm the bail bond of the petitioner.
