2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 126, 118(1), 109, 3(5) of the B.N.S.

3. Case of the prosecution is that a dispute had taken place in the market whereafter the petitioner, Anil Kumar had exhorted the other accused persons to shoot at him thereafter Golu Kumar shot at the informant's son causing injury on the left side of the stomach.

4. Learned counsel for the petitioner submits that it would be apparent from the first information report that the occurrence had taken place out of a sudden dispute in the market and the allegation upon the petitioner is of exhorting to kill. However, the specific allegation of opening fire is on Golu Kumar and he is in custody. It is also submitted that two of the other accused persons, Avinash Kumar and Ashutosh Kumar, the

Patna High Court CR. MISC. No.55170 of 2025(2) dt.22-08-2025 2/2 sons of the petitioner, are also in custody. Further, the petitioner is working as a government school teacher and has no criminal antecedent.

5. Learned APP for the State however opposed the grant of anticipatory bail.

6. Considering the facts and circumstances and also considering the fact that the specific allegation of firing is on co-accused and the petitioner is a government servant having no criminal antecedent, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Naubatpur P.S. Case No. 236 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
