The petitioner seeks bail in connection with NTPC PS Case No. 24 of 2024 instituted for the offence under Sections 308(3) & 308(4) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

Prosecution case in a nutshell is that on 10.07.2024, petitioner allegedly demanded Rs. 2,50,000/- as ransom over phone and threatened the informant. Later that night, he allegedly fired shots at the informant's factory in Kahalgaon and fled.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.54058 of 2025(2) dt.12-08-2025 2/3 that the petitioner is in custody since 20-08-2024. Petitioner bears four criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. It is submitted that no ransom amount was received by the petitioner, hence, no case is made out against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. There is no compliance of Section 103 of the BNSS, 2023. Charge sheet has already been submitted in this case and subsequently, charge is also framed. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge being framed in this case, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with NTPC PS Case No. 24 of 2024, subject to the following conditions:

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
