The petitioner is in judicial custody in connection with Habibpur P.S. Case No. 163 of 2021 under section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The allegation as per the FIR is that the police raided the house of accused Pappu Pandit who after seeing the police fled away. The police entered the house of accused Pappu Pandit and seized 58.5 litres of foreign liquor. The lady in the house, who happens to be the wife of Pappu Pandit (the petitioner herein) was arrested and it is in this way she is in jail since 24.9.2021 (as stated in para-12 of the bail application).

No.65569 of 2021(2) dt.06-05-2022 2/2 Considering the aforesaid facts that the police entered the house of Pappu Pandit and upon seizure arrested the lady, the petitioner herein who is in custody since 24.9.2021 having no criminal antecedent and the charge-sheet has already been submitted in the matter; this Court is inclined to grant her the privilege of bail.
Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Bhagalpur, in connection with Habibpur P.S. Case No. 163 of 2021.
