Heard both sides.

Petitioner seeks bail in a case under Section 7 of the E.C. Act. The police raided the shop of the petitioner and recovered 45 bags of wheat bearing F.C.I. mark and on such, it is alleged that the petitioner was keeping the wheat for the purpose of sale in black market. It is submitted that the petitioner is an agriculturist and the he was keeping the wheat in his house.

There is no material to show that the petitioner was keeping the wheat for black marketing.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S.Case No.43 of 2014.
