Mr.Ashok Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 25-01-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Kaler P.S. Case No. 34 of 2021 instituted under Sections 302 of the Indian Penal Code.

As per the prosecution story, the informant alleged that his daughter was married to Buchani Kumar in 2010 and the couple was blessed with two children. However, later, on 30.5.2021, he was informed that his daughter has been killed by the in-laws. Accordingly, the FIR was lodged. The petitioner's name came in the investigation as he was the person who used to talk with the deceased and accordingly, his name also came in the list of accused and found to be the reason behind the alleged death of the lady. Learned counsel for the petitioner submits that save

Patna High Court CR. MISC. No.55134 of 2022(2) dt.25-01-2023 2/2 and except the allegation that he used to talk with the married lady, there is nothing on record to show his implication in her death.

Learned APP on the other hand opposes the prayer of anticipatory bail.

Taking into account the fact that there is only allegation of conversation with the deceased lady with the present accused, he do not have criminal antecedent, will be cooperating in the investigation and will be ultimately facing the trial, this Court is inclined to grant him relief of anticipatory bail.

Let the petitioner be released on bail, in the event of his arrest or surrender before the subordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each in connection with Kaler P.S. Case No. 34 of 2021 to the satisfaction of learned ACJM III, Arwal, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
