The petitioners who are the father-in-law and motherin-law of the complainant are apprehending their arrest in connection with Complaint Case No. 375 of 2012 for the offences punishable under Section 498 (A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Earlier, by order dated 11.02.2015, the petitioners were directed to be enlarged on provisional bail in the event of their arrest and the notice was issued to the complainant who was directed to be added as opposite party no. 2 in the present application.
The learned counsel for the petitioners has submitted that there is no allegation of any overt act against the petitioners and only general allegation of torture and assault has been made. It
Patna High Court Cr.Misc. No.36839 of 2014 (6) dt.06-05-2015 has also been pointed out by the learned counsel that the husband of the complainant has been directed to appear in this Court in other proceeding relating to the same case where the complainant has also been directed to be present.
The learned counsel for the opposite party no. 2 has submitted that he is not opposing the prayer for bail and his prayer is only that this matter may be placed after summer vacation. The learned counsel has also accepted that the husband of the complainant has been directed to appear before this Court in other proceeding relating to the case with similar direction to the complainant.
After considering the facts and submissions on behalf of the parties including the submission that the petitioners will maintain good relation with the complainant, this Court is satisfied that the provisional bail as earlier granted should be confirmed. Accordingly, the provisional bail granted by order dated 11.02.2015 is hereby confirmed.
