JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302 and 201/34 of the I.P.C. and Sections 3⁄4 of the Prevention of Witch Practice Act, 1999. The prosecution story, in brief, is that on 18.11.2015 the grand mother of the informant, namely, Ganga Devi had gone to village Gahatara. On 25.11.2015 the informant received information that the accused persons including the petitioner identified Ganga Devi as Daain, assaulted her with lathi and danda, committed her murder, cut the dead body into pieces and threw into river Gandak.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.1.2016 and the charge sheet

Patna High Court Cr.Misc. No.30397 of 2016 (3) dt.08-09-2016 2/2 has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been named in the F.I.R. merely on the basis of suspicion. As per the statement recorded in paragraph 5 of the case diary, it is a case of last seen. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Khagaria in connection with Khagaria (Gangaur) P.S. case No.746 of 2015 corresponding to Sessions Trial No.140 of 2016.
