The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

As per the prosecution case, total 18 litres of country made liquor have been recovered from the bag kept on Splendor Motorcycle bearing Reg. No. BR- 28D-4384. Thereafter two persons arrested and motorcycle was also seized. It is submitted on behalf of the learned counsel for the petitioner that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner only come due to seized motorcycle. He further submits that the petitioner had

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge Cum Special Judge, Excise, Gopalganj, in connection with trial no. 4609 of 2021, arising out of excise case no. 267 of 2020, subject to condition as laid down under section 438(2) of the code of criminal procedure.
