1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 323, 341, 379, 307, 504, 506 and 34 of the Indian Penal Code.

The learned counsel for the petitioners submit that the petitioners are persons with clean antecedent and the informant alleges that on 25.04.2024 at 10 p.m., Manu Kumar called him and took him to the western side of the field of the village and started discussing regarding four lacks rupees taken by the petitioners in marriage of their sister seven years ago and

No.60389 of 2024(2) dt.30-09-2024 2/3 on the said issue, it is alleged, Manu and Anu started assaulting the informant with lathi and Rina Devi also abused the informant, it is next alleged that Manu and Anu assaulted the informant on his head by lathi, causing injury and Rina Devi snatched the golden chain of the informant.
4. The learned counsel submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that it absolutely does not stand to reason that as to why the petitioners after seven years would have gone to the house of the informant for discussing the money which they had taken in marriage of their sister. It is also submitted that allegation of assault is also fabricated, but then, even presuming what has been alleged is true without admitting when the injury suffered by the injured is simple in nature which amply demonstrates that petitioners never had any intention of committing a serious occurrence.
5. The learned APP for the State opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail
Patna High Court CR. MISC. No.60389 of 2024(2) dt.30-09-2024 3/3 on their furnishing bail-bonds in the sum of Rs. 10,000 /- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Akbarpur P.S. Case No. 14 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
