The petitioner seeks bail in a case registered under Sections 356, 379 of the Indian Penal Code.
Allegation is that two unknown persons took away the motorcycle of the informant along with money, which was kept in dicky of the motorcycle.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.6.2019. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. There is no recovery of any incriminating article from the possession of the petitioner. The

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Chakiya P.S. case No.74 of 2018.
