Petitioners apprehend their arrest in connection with Kalyanpur P.S. Case No.122 of 2021, registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
The petitioners along with other other co-accused persons killed the daughter of the informant for non-fulfillment of demand of additional dowry.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail
Patna High Court CR. MISC. No.65701 of 2021(4) dt.22-08-2022 2/2 application. It is further submitted that petitioner no.1 is elder brother of husband of the deceased and petitioner no.2 is elder brother's wife of husband of the deceased. It is submitted that petitioners are living separately and they have no manner of concern with the family affairs of the deceased and her husband. It is also submitted that the husband of the deceased has already been granted regular bail by the learned court below itself. The learned APP for the State opposed the prayer for anticipatory bail of the petitioners.
Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Motihari, East Champaran in connection with Kalyanpur P.S. Case No.122 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
