JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392, 411 of the Indian Penal Code.

Petitioner is not named in the first information report but his name came in this case in confessional statement of coaccused, Barun Yadav and after that the investigating officer filed a petition before the court below for issuance of custody warrant against the petitioner as petitioner was in jail custody in connection with another case and thereafter, petitioner was remanded in the present case.

Patna High Court Cr.Misc. No.30189 of 2016 (2) dt.04-08-2016 2/2 accused, Barun Yadav has already been granted privilege of bail and so far as petitioner is concerned, he is languishing in jail custody since long.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Naugachia in connection with Dholbajja P.S. Case No. 02 of 2009.
