JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2017 The appellant seeks regular bail in connection with Sheikhpura (Mahila) P.S. Case No. 51 of 2016, registered for offences punishable under Sections 457, 354, 323, 506 and 379 of the Indian Penal Code, and Section 3(2)(VK) 3(1) of SC/ST (POA) Act.
Allegation against the appellant is of outraging the modesty of the informant and also of abusing her. It has been submitted on behalf of the appellant that he has falsely been implicated in this case and appellant is handicapped person. Further he has no criminal antecedent and has been in judicial custody since 04.07.2017. Heard learned Special P.P. also.
Having heard both sides, considering the facts and
Patna High Court CR. APP (SJ) No.2184 of 2017 (4) dt.12-09-2017 circumstances of the case and the nature of allegation, at this stage, I am not inclined to release the petitioner on bail, at least at this stage. His application for regular bail is, accordingly, dismissed.
However, the appellant may renew his prayer for bail after framing of charge in this case.
