JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks regular bail in a case registered for the offence punishable under Section 414 of Indian Penal Code and Section 7 of the Essential Commodities Act. It is the petitioner's case that on 28.10.2009, the Police recovered one thousand liters of kerosene oil from the petitioner's house.

Learned counsel for the petitioner submits that the room from where the articles were recovered was in fact let out to one Dilip Prasad and it was in his possession. He further submits that the seizure was made in his absence.

It has been stated in paragraph No. 3 of the application that the petitioner has no criminal antecedent.

No.9482 of 2015 (2) dt.04-03-2015 P2/2 In view of the above, let the petitioner Bishwanath Sah be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Saran (Chapra) in connection with Nagar Chappra P. S. Case No. 254 of 2009.
