JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-09-2016 Heard learned counsel for the Petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 15.3.2016 in a case registered for the offence under Section 392 of the I.P.C. Petitioner was caught in connection with Rajgir P.S. case No.09 of 2016 when petitioner and others allegedly had assembled to commit dacoity and after that the petitioner and his associates confessed their guilt disclosing their involvement in the present case also and on the basis of their confessional statement the looted ornaments were recovered from the room of the petitioner.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.27837 of 2016 (3) dt.19-09-2016 2/2 well as submissions of the parties, I am not inclined to release the petitioner on bail and hence his prayer for bail in connection with Sessions Trial No.296 of 2016 (Rajgir P.S. case No.248 of 2015) pending in the court of 7th Additional Sessions Judge, Nalanda at Bihar Sharif stands rejected.
