2. In this case, the petitioner is seeking regular bail in connection with Mahila P.S. Case No. 24 of 2024, registered for the offences punishable under Sections 341, 323, 376, 417, 504/34 of the IPC.
3. As per allegation, the petitioner, at the pretext of marriage, had physical relations with the victim. Further, he aborted her pregnancy and when she demanded maintenance of the child, born out of wedlock of the couple, the petitioner misbehaved with her and also assaulted her.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.58501 of 2024(2) dt.22-08-2024 2/2 this case. The FIR itself shows that the case has been lodged for not providing maintenance to the child. He has submitted further that the victim had made similar allegation against one Mithu @ Margub @ Imran with similar allegation and Mithu @ Margub @ Imran was acquitted by the court of Adhoc Additional Sessions Judge IVth, Araria in Sessions Trial No. 954 of 2013 vide judgment and order dated 01.04.2014. It has also been submitted that the informant is habitual to lodge forged and fabricated cases against innocent persons. The petitioner is under custody since 03.05.2024.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Araria in connection with Mahila P.S. Case No. 24 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
