JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 363, 366, 366(A) of the Indian Penal Code. As per prosecution, petitioner along with other accused persons kidnapped the minor daughter of the informant. It is submitted on behalf of the petitioner that the petitioner is innocent and has falsely been implicated in the present case. It has further been submitted that the victim has been recovered from the house of his grand mother. Her statement u/s 164 Cr.P.C. has been recorded. In her statement she has stated that she was taken by the petitioner to his grand mother and he left her there. She was kept there for ten days. The petitioner has not
Patna High Court Cr.Misc. No.32549 of 2017 (2) dt.13-07-2017 2/2 outraged her modesty. The petitioner is in custody since 27.03.2017.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., First, Jhanjharpur, District- Madhubani, in connection with Lakhnaur (R.S.O.P.) Case No. 28 of 2017.
