This is an application for bail in connection with Ben P.S. Case No. 54 of 2017 registered for the offences punishable under Sections 25(1-B)(a) and 26 of the Arms Act.
Allegation against the petitioner is of recovery of one country made pistol and three cartridges from his house. Submission of learned counsel for the petitioner is that recovery has been made from the joint house of petitioner and his family members and nothing has been recovered from his conscious possession and he is in jail since 21.5.2017 having no criminal antecedent.

Having heard both sides and in view of facts and
Patna High Court Cr.Misc. No.42366 of 2017 (2) dt.12-09-2017 2/2 circumstances, this application is disposed of with a direction that once charge has been framed in this case or petitioner completes five months period in judicial custody, whichever is earlier, he will be released on bail by the court below to its satisfaction, if an application for bail on behalf of petitioner is filed.
