The petitioner apprehends his arrest in a case registered for the offence punishable under section 420, 467, 468, 120B/34 of the Indian Penal Code, section 7 of Essential Commodities Act, sections 51/53 of Disaster Management Act 2005 and section 3 of the Epidemic Disease (Amendment) Act 2020. Allegedly, the F.I.R. named accused persons are involved in black marketing of huge quantity of oxygen cylinders. It is alleged that petitioner is the proprietor of M/s Sati Security, which is also an accused in this case.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case on the basis of suspicion.

The allegation leveled against the petitioner is not specific rather general and omnibus in nature. Petitioner is the proprietor of the accused firm M/s Sati Security, which is a duly registered firm situated at Katihar has been doing its business in legal manner without any complaint from any corner. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case and from the perusal of annexure- 2 and 3, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in Katihar Town, P.S. Case No. 233 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
