Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code Section 47(a) of the Excise Act.

23 bottles of whisky are said to have been recovered from the seat of a bus and the petitioner and one other co-accused were found sleeping on the aforesaid seat. Moreover, the petitioner does not have any criminal antecedent and is languishing in jail custody since 22.06.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.36761 of 2016 (2) dt.31-08-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj, in connection with Galgalia P.S. Case No. 31 of 2016.
