JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-08-2017 The appellants seek regular bail in connection with Nabinagar P.S. Case No. 114 of 2017, registered for offences punishable under Sections 341, 323, 384, 385, 352, 504 and 34 of the Indian Penal Code and Section 3(i)(r)(s) of SC/ST (POA) Act. Allegation against the appellants is of demand of rangdari from the informant and also of abusing the informant by his caste name.

It has been submitted on behalf of the appellants that they have falsely been implicated in this case and no occurrence as alleged has ever taken place and they have been implicated in this case by the informant with ulterior motive.

Having heard both sides, considering the facts and

Patna High Court CR. APP (SJ) No.2084 of 2017 (3) dt.19-08-2017 circumstances of the case and also that both the appellants have criminal antecedents, as such, I am not inclined to release the appellants on bail, their appeal for regular bail is, accordingly, dismissed.

However, as the appellants are in custody for three months, the trial court is directed to expedite the trial and try to conclude it within a period of nine months.
