The petitioner is languishing in custody in connection with Sessions Trial No. 260 of 2016, arising out of Ramkrishna Nagar P.S. Case No. 295 of 2015 for the offences instituted under Sections 363 and 365 of the Indian Penal Code but later on charge sheet has been submitted under sections 364, 201 and 120B of the Indian Penal Code.

The allegation against the petitioner is that he along with other co-accused was also involved in kidnapping the husband of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.12.2015. The charge sheet has

Patna High Court Cr.Misc. No.30697 of 2016 (4) dt.15-09-2016 2/2 been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the First Information Report. In course of investigation, suspicion has been raised against the petitioner. There is no substantive evidence to implicate the petitioner in the present case. On behalf of the state it has been submitted that the petitioners' name has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Patna, in connection with Sessions Trial No. 260 of 2016 (Ram Krishna Nagar P.S.
