JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/34 of the Indian Penal Code and 27 of the Arms Act. No doubt, the informant is not an eye witness of the alleged occurrence but she specifically stated in her written report as well as her further statement that the mother and the sister of deceased were present on the place of occurrence. Subsequently, the statement of the mother and the sister of the deceased was recorded at paragraph-5 of the case diary which goes to show that both the witnesses claimed themselves to be eye witnesses of the alleged occurrence and stated that it was the petitioner who shot fire on the deceased.
Patna High Court Cr.Misc. No.29501 of 2016 (5) dt.18-11-2016 2/2 Considering the above-said facts and circumstances as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, prayer for bail of the petitioner in connection with Naubatpur P.S. Case No. 712 of 2015 stands rejected.
