JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

A dacoity was committed in the house of the informant, who lodged present case against unknown persons. In course of investigation, one co-accused Dinesh Choudhary was arrested and confessed his guilt disclosing the name of the petitioner. Subsequently, petitioner was remanded in this case on 18.4.2016 but up till now petitioner has not been put on Test Identification Parade. Moreover, nothing has been recovered from conscious possession of the petitioner.

Accordingly, the petitioner above named is directed

Patna High Court Cr.Misc. No.28014 of 2016 (2) dt.26-09-2016 2/2 to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad in connection with Salaiya P.S. Case No.5 of 2015.
