The petitioner apprehends his arrest in connection with Bhabhua (Sonhan) P.S. Case No.56 of 2014 for the offences punishable under sections 147, 148, 149, 341, 337, 324, 326, 307, 302 and 504 of the Indian Penal Code and section 27 of the Arms Act.
Mr. Sangeet Deokuliar, learned counsel appearing on behalf of the petitioner with reference to the FIR has submitted that even when the petitioner has been named therein, no specific overt act has been assigned to him although the FIR charges some of the accused persons of individual assault. He further submits that although in the concluding portion of the FIR there is a reference against the accused of pelting stones on
Patna High Court Cr.Misc. No.35997 of 2014 (2) dt.11-02-2015 the prosecution party but that is an omnibus nature of allegation. Having heard learned counsel for the parties and taking note of the nature of allegation, let the petitioner, Ram Pati Yadav in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua (Sonhan) P.S.
